Please read these terms carefully before using the app
The Service is available only to users who are 13 years of age or older. If you are under 13, you may use the Service only with the involvement of a parent or guardian.
In order to use the Service, you must create an account. You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account information and for all activity that occurs under your account.
You may use the Service for your own personal, non-commercial use. You may not use the Service for any illegal or unauthorized purpose.
You may not:
We may terminate your account at any time for any reason. We may also terminate the Service at any time for any reason.
You agree to indemnify and hold us harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service.
These Terms will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions.
These Terms constitute the entire agreement between you and us with respect to the Service and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will remain in full force and effect.
No waiver of any provision of these Terms will be effective unless in writing and signed by both parties.
The headings in these Terms are for convenience only and will not affect their interpretation.
These Terms may be executed in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument.
These Terms are in the English language only. No translation of these Terms will be binding.
We reserve the right to change or modify these Terms and Privacy Policy at any time. If we make any material changes, we will notify you by email or by posting a notice on the Service. Your continued use after the effective date of any changes constitutes your acceptance of those changes.
Modification and Termination: We reserve the right to modify, suspend, or terminate the App or these Terms at any time, with or without notice. We may also impose limits on certain features or restrict your access without liability or prior notice.
My Day offers a Premium subscription plan ("Premium") that unlocks additional features within the App, including Focus Timer, Reminders, Analytics, Quote of the Day, and Collaborate (Todo Sharing).
Billing and Renewal. Premium is available for $2.99 per month. Your subscription auto-renews at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
Payment. All payments are processed by Apple App Store, Google Play, or Microsoft Store depending on the platform you use. We do not collect or store your payment information.
Cancellation. You may cancel your Premium subscription at any time through your platform's subscription management settings. Cancellation takes effect at the end of the current billing period; we do not provide refunds for any unused portion of a subscription period.
Feature Availability. Premium features are available for as long as your subscription remains active. If your subscription expires or is cancelled, access to Premium features will be revoked at the end of the current billing period. We reserve the right to modify, add, or remove Premium features at any time.
Collaborate (Todo Sharing). By using the Collaborate feature, you agree that content in shared lists is accessible to all users you invite. You are solely responsible for the content of shared lists and for the collaborators you invite. You may not use Collaborate to share inappropriate, abusive, or unlawful content.
This section applies only when you download or use the My Day app (the "App") from the Apple App Store. In the event of any conflict between this section and the rest of these Terms, this section governs with respect to the App Store version of the App.
Acknowledgement. You and we acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. ("Apple"), and that we, not Apple, are solely responsible for the App and its content. These Terms do not provide usage rules for the App that conflict with the Apple Media Services Terms and Conditions as of the date you accepted these Terms.
Scope of License. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Maintenance and Support. We are solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
Product Claims. We, not Apple, are responsible for addressing any claims relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of the HealthKit and HomeKit frameworks.
Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Developer Name and Address. Any questions, complaints, or claims with respect to the App should be directed to LaunchX AI Technologies at hello@mydayplan.app.
Third Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App.
Third Party Beneficiary. You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
